Other photography contract terms & conditions
ENTIRE AGREEMENT: This agreement contains the entire understanding between Brenden Ward Photography and the client request service. It replaces any prior agreements that may have been made.
CONFIRMATION: A signed contract and deposit are necessary to confirm the stated photography services from Brenden Ward Photography
COOPERATION: The client and Brenden Ward Photography consent to cheerfully cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. We recommend that the photographer is provided with a helper who will point out key individuals to be photographed. The photographer may also require the assistance of the helper in organising family groups. The client will also agree to give the photographer sufficient warning of key events at the venue to give the photographer time to prepare e.g., cutting the cake, speeches etc. Please note that not all guests at parties and gathering like having their photo taken. In such cases the photographer will use his discretion but cannot be held responsible for a lack of photos of these people
THE SCHEDULE : Our shooting schedule, style of working and experience are designed to achieve a mouth watering set of photos for the client, accomplished with good humor and enjoyed by all concerned. Both the client and Brenden Ward Photography therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases were the party or gathering does not run on time (for example, extreme lateness we cannot guarantee to take our normal set of photos although in such circumstances we will do our absolute best to compensate
PAPARAZZI GUESTS: All your guests will have digital cameras and all your guests will want to photograph the event. In the spirit of cheerful cooperation the client to give the photographer precedence over your guests in order to take the photographs required for the photography services described above.
We cannot be held liable for a lack of wedding photos if the photographers work has been continually interrupted by guests taking their own photos of the event.
HOUSE RULES: Note the photographer is sometimes limited by rules imposed by venue management as to what can and cannot be done. For example some venues restricted the use of flash photography, and others will insist that the photographer shoot from a specific location. In such circumstances the client agree to accept the technical limitations that may be imposed on the equipment used. We advise the client to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned.
COPYRIGHT LAW: English Copyright Law states that the copyright of photographs remains with the photographer. Copyright ownership of your photos is transferred to the client upon full payment under the following conditions. The digital images taken by Brenden Ward Photography are for personal use by the client and their friends and relatives. If selling the photos for profit the client, their friends and relatives must obtain permission from Brenden Ward Photography
MODEL RELEASE: The client grant Brenden Ward Photography and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the clients for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The client hereby releases Brenden Ward Photography and its legal representatives, heirs and assigns from all liability and claims in connection with the images.
LIMIT OF LIABILITY: If the photographer is too ill or becomes injured and cannot supply the photography services specified above, Brenden Ward Photography will do everything possible to book a replacement photographer. Under normal circumstances a second photographer from Brenden Ward Photography is on standby for the day. Please note that our business covers in excess of 40 weddings and corporate events a year and to date this has never happened. If a replacement photographer cannot be found in these circumstances, liability is limited to a refund of any payments received. Brenden Ward Photography have working methods in place to prevent the loss or damage to your images (the digital images are backed up constantly to separate storage media throughout the event, duplicate equipment is on hand in case of breakage or failure). However, there exists the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond the control of Brenden Ward Photography. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of original images supplied.
BOOKING DEPOSITS: In the event of the bride and groom canceling the event for whatever reason the booking deposit is non refundable. It will be considered as liquidated damages to Brenden Ward Photography. Once this agreement has been received failure of the event to take place will result in full payment of the agreed amounts.
DELIVERY OF CD/DVD: Proof Printing and photo CD or DVDs are normally ready within 7 days of the wedding. The completed wedding video normally takes one month although previews for editing purposes will be available before this time. Wedding albums are expected to be completed and delivered within 10 working days but Brenden Ward Photography cannot be held responsible for delays in manufacture of the albums.
